Should You Wait Until After the Holidays are Over to File for Divorce?

Should You Wait Until After the Pandemic is Over to File for Divorce

Should you wait until after the holidays are over to file for divorce in Louisville or Jefferson County?  Many married partners enter the holidays with a feeling of emptiness, aware of the shortcomings in their relationship and yet not wanting to allow thoughts of ending a marriage to interfere with the holiday season.

Are you sure your marriage is irreconcilably broken? Why should you consider moving forward with divorce planning before the holidays? If you wait until after the first of the year to file for divorce you will be forced to wait a minimum of another 60 days (at least) before the divorce can be finalized under Kentucky law, presuming you and your spouse are in complete agreement on every aspect of the case.  While an uncontested divorce may be the fastest and easiest route to divorce in Kentucky, the mandatory waiting period combined with the present backlog in cases could extend your case months and perhaps more than a year into the future.

Second, every aspect of the divorce, from the division of marital property and retirement assets to child custody and parenting time and even maintenance (often referred to as spousal support) must be completely settled before your divorce case can be finalized. You may feel there are no real areas in dispute now, however, as soon as the actual divorce proceedings are underway you may be surprised at how your own thoughts, as well as the positions of your (soon-to-be-former) spouse have changed.

The experienced divorce and family law lawyers at Dodd & Dodd, PLLC often step in to guide our clients as they negotiate with their spouse, and work to help the parties to reach an effective resolution that accomplishes our own client’s goals and objectives.
