No. Many divorce cases are resolved through negotiation or mediation. Court involvement may still be necessary when spouses cannot agree, when urgent orders are needed, or when one party is unwilling to provide information or negotiate fairly.
An uncontested divorce generally means both spouses have reached agreement on the issues that must be resolved. A contested divorce means one or more issues remain disputed, such as property division, maintenance, parenting time, child support, or decision-making for the children.
Kentucky courts divide marital property equitably, which does not always mean equally. The court may consider the nature and value of the property, each spouse’s contributions, the length of the marriage, and each spouse’s financial circumstances.
Retirement benefits earned during the marriage may be marital property. Dividing a pension, 401(k), IRA, or other retirement account may require valuation, tax planning, and a specialized court order so the transfer is completed properly.
Parenting decisions are based on the child’s best interests. The court may consider each parent’s relationship with the child, the child’s needs, the parents’ ability to cooperate, the stability of each home, and other circumstances affecting the child’s welfare.
Some family court orders can be modified when legal requirements are met and circumstances have materially changed. The standards differ depending on whether the requested change involves custody, parenting time, child support, or maintenance.
Mediation is frequently used in Jefferson County family law cases and may be ordered by the court. It gives both parties an opportunity to work toward an agreement while retaining more control than they would have if a judge decided the disputed issues.

Allen is the co-author of Kentucky Domestic Relations Practice (2nd edition), one of the leading references used by family law attorneys throughout the state. He has served as Chair of the Family Law Sections of both the Kentucky Bar Association and the Louisville Bar Association, and currently serves as Vice-Chair of the Kentucky Bar Association Family Law Section.
